1. Acceptance of Terms

By accessing or using MiraLux AI ("the Service"), operated by MiraLux AI ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not access or use the Service.

2. Description of Service

MiraLux AI is an AI-powered content generation platform that allows users to create images and videos using artificial intelligence. The Service may include image generation, video generation, model creation, image reference tools, motion tools, gallery features, credit-based usage, and related tools accessible through our web application.

3. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately if you believe your account has been accessed without authorization.

4. Subscriptions, Credits, and Payments

The Service operates on a credit-based subscription and usage model. By subscribing to a plan or purchasing credits, you agree to pay the fees associated with your selected plan or purchase.

• Subscription credits reset at the beginning of each billing cycle and do not roll over unless stated otherwise.
• Bonus credits or separately purchased credits may have different expiration rules as shown at the time of purchase.
• Credits are consumed when you use generation features, including image generation, video generation, model creation, image swap, motion control, or other paid tools.
• If a generation request is blocked or rejected by moderation before processing, credits should not be consumed or should be returned where technically possible.
• All payments are processed through our third-party payment provider. We do not store your full payment card information.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• Refunds are handled on a case-by-case basis at our discretion, except where required by applicable law.

5. Acceptable Use

You agree not to use the Service to:

• Generate content depicting real individuals without their explicit consent.
• Create, request, upload, or generate content involving minors in any sexual, exploitative, suggestive, or inappropriate context.
• Create content involving minors where age, identity, or context is unclear or potentially unsafe.
• Generate illegal, defamatory, abusive, harassing, hateful, violent, non-consensual, exploitative, or otherwise harmful content.
• Generate or request explicit sexual content that violates our platform rules, moderation systems, third-party provider rules, or applicable law.
• Upload images, videos, or materials that you do not have the right to use.
• Impersonate another person or misrepresent your identity or authority.
• Attempt to reverse-engineer, decompile, extract, copy, or misuse the underlying AI models, prompts, systems, or platform logic.
• Resell, redistribute, sublicense, or commercially exploit access to the Service without our written permission.
• Use automated scripts, bots, scrapers, or unauthorized tools to access the Service.
• Circumvent rate limits, moderation systems, credit restrictions, access controls, or security measures.
• Use the Service in a way that violates any applicable law, regulation, third-party right, or platform policy.

We reserve the right to suspend, restrict, or terminate your account if we determine, at our sole discretion, that you have violated these Terms or used the Service in a way that creates legal, safety, security, reputational, or operational risk.

6. User Content and Uploaded Materials

You retain ownership of images, videos, prompts, reference materials, and other content you upload to the Service.

By uploading content, you grant us a limited, non-exclusive, worldwide license to host, store, process, transmit, display, and use that content solely as needed to provide, maintain, secure, moderate, and improve the Service.

You represent and warrant that you have all rights, permissions, and consents necessary to upload and use your content with the Service. You are solely responsible for the content you upload and the outputs you request or generate.

7. Generated Content

Subject to these Terms, your active subscription, and applicable law, generated content produced through the Service is owned by you.

You may use generated content for personal and commercial purposes, provided your use does not violate these Terms, applicable law, third-party rights, or the rules of any platform where you publish the content.

We do not guarantee that generated content will be unique, free of errors, suitable for a specific purpose, or legally safe for every commercial use. You are responsible for reviewing generated content before publishing or using it.

8. Moderation and Content Restrictions

The Service may use automated and manual moderation systems to detect, block, restrict, or remove content that violates these Terms, our safety rules, provider requirements, or applicable law.

Generation requests may be refused, modified, or blocked.

We may remove generated content or uploaded materials if we believe they violate these Terms or create risk for the Service.

9. Third-Party Services

The Service may rely on third-party providers for payments, authentication, AI generation, storage, moderation, hosting, analytics, infrastructure, and related functionality.

Your use of certain features may be subject to third-party terms, policies, or technical limitations.

We are not responsible for outages, errors, delays, moderation decisions, or service limitations caused by third-party providers.

10. Service Availability and Changes

We may modify, suspend, restrict, or discontinue the Service or any part of it at any time, with or without notice.

We may update pricing, credit costs, subscription features, available models, moderation rules, and platform functionality.

Continued use of the Service after changes are posted or made available constitutes acceptance of those changes.

11. Termination

We may suspend or terminate your account at any time if we believe you violated these Terms, created risk for the Service, abused the platform, or used the Service in a prohibited way.

Upon termination, your right to access and use the Service ceases immediately.

Unused credits may be forfeited upon account termination unless otherwise required by applicable law.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

We do not warrant that the Service will be uninterrupted, secure, error-free, accurate, complete, or suitable for your intended use.

AI-generated content may contain errors, artifacts, distortions, inaccuracies, or unexpected results.

13. Limitation of Liability

To the maximum extent permitted by law, MiraLux AI and its owners, operators, employees, contractors, partners, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Service.

This includes, but is not limited to, loss of profits, loss of data, loss of content, business interruption, reputational harm, or claims arising from generated content.

14. Indemnification

You agree to indemnify, defend, and hold harmless MiraLux AI and its owners, operators, employees, contractors, partners, and service providers from any claims, damages, liabilities, losses, costs, or expenses arising from your use of the Service, your uploaded content, your generated content, your violation of these Terms, your violation of applicable law, or your violation of any third-party rights.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a revised "Last updated" date.

Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
